CAT shocker for Bidari
The Central Administrative Tribunal on Friday struck down the appointment of Director General of Police Shankar Mahadev Bidari as null and void and instructed the state government to appoint the senior-most IPS officer and DGP-Home Guards, Fire & Emergency Services A.R. Infant as ad-hoc DG&IGP till the government appoints a new head. The CAT, in reply to a writ petition filed by Mr Infant challenging the appointment of Mr Bidari in December last year, quashed the appointment of Mr Bidari after taking cognisance of the allegations of human rights violations against him during his tenure as head of the Special Task Force,constituted to nab notorious brigand Veerappan.
CAT judicial member K.V. Suresh, in a 75-page order, cited the human rights allegations against Mr Bidari and said these must be placed before the UPSC. CAT also said that by appointing Mr Bidari, the State had ignored the seniority of Mr Infant. It has asked the state government to send a fresh list of officers to the UPSC for empanelment to the post and the Commission to empanel the officers. “Till such time let the government appoint Mr Infant as ad-hoc DG&IGP,” it said.
Mr Infant, challenging Mr Bidari’s appointment, had alleged that it was done in haste, by overlooking merit, integrity and seniority and was in gross violation of the Supreme Court directive. A prominent City-based NGO — Vimochana — in a representation to the governor, which was forwarded to the UPSC, had alleged that women were raped and several crimes were committed by the STF personnel under Mr Bidari’s leadership.
