Complaint against DVS, chief secy
A private complaint has been filed against former Chief Minister D.V. Sadananda Gowda, Chief Secretary S.V. Ranganath, Bengaluru Urban Deputy Commissioner M.K. Aiyappa and others for allegedly granting six acres of land to an educational institution despite the High Court setting aside the grant of same land some years ago. The complainant, C.R. Nagaraj, who has also listed the then BDA commissioner Bharat Lal Meena and former special DC G.S. Nayak as accused, stated that the bureaucrats and politicians concealed the court orders, which was even confirmed by the Supreme Court, to gobble up 48 acres of land which was already allotted to rural residents under a central government scheme in 1975.
According to the complaint, the State government had acquired around 52 acres of land on Survey Nos. 38 and 39 at Giddadakonenahalli near Yeshwanthapur to allot sites to siteless rural people. After the acquisition, 910 sites were formed and allotted to people. Despite the allotment, the BDA issued a preliminary notification for acquisition of land for a layout on the same survey numbers. Before the final notification in 2003, through a proceeding, the government granted 4 acres to one Basaveshwara Little Flower Educational Society and 6 acres to Buddha Educational Society on the same survey numbers.
“The matter had reached the High Court which had held that the government had no right to allot the same land to anyone else. The aggrieved party – Buddha Educational Institution, represented by K. Chandrashekhar – appealed before the Supreme Court, which was dismissed. A review petition was also dismissed reiterating that the site allottees were entitled to the sites”, the advocate for the complainant said. However, since 2011, the BDA, tried to demolish the constructions in these sites and the Bengaluru Urban DC’s office attempted to displace the site allottees. Meanwhile, Buddha Educational Institution was allotted a different piece of land in Avverahalli. However, not pleased with the alternate land, the educational institution allegedly put pressure to get the same land.
The then special DC, G.S. Nayak, prepared a false report and also marked a copy of his confidential report to the educational institution and forwarded it to the government. It was tabled before a cabinet meeting and the then Chief Minister D.V. Sadananda Gowda issued the order in June 2012 allotting the same six acres land to Buddha Educational Institution.
