HC ensures justice to lab technician
Kidwai Memorial Institute of Oncology committed a blunder recently by transferring a lab technician, who has been with the organisation for the last two decades, to the accounts department. The institute also did not give sufficient reasons for the transfer while issuing the order effective February 28, 2012. An aggrieved S. Lokaraju (44) approached the Karnataka High Court.
The court, ruling in favour of Mr Lokaraju, observed that the petitioner had the experience of over two decades as a laboratory technician and the transfer order did not assign proper reasons for transferring a technical person to the accounts section. The advocate arguing for the institute said that during 2012, 2013, 2014 and 2015, as many as 118 employees would retire from the institute accounts section and they had to transfer Mr Lokaraju the smooth functioning of the section. The court observed: “The reasoning of the institute is not convincing and it has not been reflected in the transfer order. Further, it is not in the interest of the institution.”
The court held that since Mr Lokaraju has already reported for duty at the accounts section, it is necessary for the institute to place him appropriately and make use of his experience as a lab technician. Mr Lokaraju, who has no experience in the accounts department, will be of no use there, it said. “The art of management demands that the best from every employee is extracted. But in this case, the institute has given a go-by to such a principle,” the court observed. It disposed of the matter and directed the institute to accommodate the petitioner on a technical wing not later than June 30.
