HC puts off bail pleas of BSY, sons to Monday
The high court on Friday adjourned the petitions of former chief minister B.S. Yeddyurappa and his relatives, seeking anticipatory bail to Monday.
The CBI, while filing objections to the bail pleas, raised the same issues that it did before the CBI special court against granting bail to the accused in the alleged illegal land denotification related to illegal mining.
Senior advocate C.V. Nagesh, arguing for Mr Yeddyurappa and others, submitted that the cases being investigated by the CBI are the exact copies of the first complaint on illegal land denotification filed by advocate Sirajin Basha. Mr Yeddyurappa has already been granted bail in the earlier cases, he added.
“The high court has also quashed the FIR. There have been no violations of conditions imposed by the high court while granting bail,” he argued.
He said the high court has already quashed the FIR filed by the Lokayukta police against Mr Yeddyurappa in connection with the Lokayukta report on illegal mining and also Governor’s sanction for initiating criminal proceedings against him.
The CBI advocate argued that granting of bail to the accused would hamper the investigation and the CBI would also need custodial interrogation of the accused to complete the investigation on time, he added.
The CBI stated that the former chief minister is a powerful politician who can influence witnesses in the case.
“The witnesses in the case are all government servants who had earlier worked under him. They need to be examined and documents have to be collected from them. If Mr Yeddyurappa is sanctioned anticipatory bail, it will affect the investigation,” the agency stated.
BSY sons get CBI summons
The Central Bureau of Investigation, which is investigating former chief minister B.S. Yeddyurappa’s alleged role in illegal mining and the kickbacks he and his family members received from some mining companies to facilitate illegal mining, on Friday reportedly issued summonses to Mr. Yeddyurappa’s sons – B.S. Raghavendra, B.S. Vijayendra and son-in-law R.N. Sohan Kumar, co-accused in the same case – to appear before the investigating officer on Saturday.
The summonses were issued after the Special CBI court rejected the anticipatory bail applications of the four.
Opposing their bail plea, the CBI said that custodial interrogation of the accused is necessary because of the seriousness of the charges.
The CBI will issue summons to Mr. Yedyurappa after they complete the interrogation of his family members.
The agency may also arrest the accused at an “appropriate time,” and “in the interest” of the case, said an official source.
