Court directs state to follow SC guidelines on political agitations

The Madras high court on Tuesday directed the state government to strictly follow the guidelines laid down by the Supreme Court in the matter of parties holding agitations and demonstrations.

Advocate R. Balasubramanian had filed a PIL seeking a direction to authorities to take measures to curb the barbarian activity of the DMK to avoid suffering to the public through Arajaga Porattam on July 4 in the name of Ara Porattam for their political gain and party publicity.

The DMK party has announced a protest on July 4 against the state government for allegedly foisting cases and arresting party members in connection with land grabbing.

“Although a mandamus has been sought for in the nature of injunction, the persons against whom such injunction has been sought for have not been impleaded as party respondents. However, advocate general submits that the government will look into the matter and ensure that law and order will be maintained,” said a division bench of Chief Justice M.Y. Eqbal and Justice T.S. Sivagnanam.

“It goes without saying that the respondents concerned shall strictly follow the guidelines laid down by the Supreme Court in the case of Destruction of Public and Private Properties Vs State of A.P. passed on the basis of reports submitted by Justice K.T. Thomas (Thomas Committee) and F.S. Nariman (Nariman Committee),” the bench said.

The guidelines of the Thomas Committee stated that if the demonstration turns violent, the officer-in-charge should ensure that the events are videographed through private operators and also request such further information from the media and others on the incident.

The police should immediately inform the state with reports on the events and the state government should prepare a report and file a petition in the high court or the SC as the case for the court in question to take suo motu action.
