HC orders notice to state law secretary
The Madras high court on Thursday ordered notice to the state law secretary on a contempt application relating to establishing a law college in Tindivanam returnable by four weeks and filed by the Vanniyar Educational Trust.
The trust contended that the high court had on November 23, 2011, allowed its petition seeking a direction to the state government to grant NOC for starting a private law college in the name and style of Saraswathi Law College in Tindivanam to enable it to approach the competent authorities for grant of affiliation and final approval for the college. The appeal filed by the state government was also dismissed.
A positive direction was given by the court to grant NOC within four weeks, but the authorities to nullify the order, deliberately and wantonly issued a letter dated June 14, 2012, stating that the petitioner has to submit a fresh application for grant of NOC to start the private college in the prescribed form along with the fee prescribed in the government order dated March 5, 2012.
This G.O was not applicable to the petitioner as they have filed the application before the G.O and this had been expressed by this court when they produced the order at the time of hearing.
The authorities only intention was to get over the order of the high court in one way or other for some political vested interest.
The petitioner sent a legal notice to the authorities to implement the order of the high court but no action was taken.
