Govt to go whole hog for MCD control

New Delhi, Feb. 3: After failing to get any help from the Centre for assuming control over the MCD, Delhi government on Wednesday decided to draft a new municipal law to replace the Delhi Municipal Corporation Act, 1957 in order to bring it under its jurisdiction.

Chief minister Sheila Dikshit on Wednesday gave the go ahead to officials to draft a new municipal law after the Union home ministry did not yield to its requests for grant of full control over the MCD to it.Sources stated that in a Cabinet meeting on Wednesday, the chief minister constituted a committee headed by chief secretary Rakesh Mehta and principal secretaries, urban development and law, as members to oversee framing of the new law.“Once Delhi government frames the new law, it will ask the Centre to repeal the DMC Act, 1957 under which the MCD is administered by the Union home ministry. The new law will bring the MCD under the Delhi government as per the provisions for local bodies,” said a senior official, who added that the local bodies laws framed in Punjab and Haryana in 1994 could be possible models for the new law.Justifying the decision, a Delhi minister, not willing to be quoted, stated that the DMC Act, 1957 was made when the population of the capital was about one million, but it has now gone up to 1.8 crores and by 2020 it will be more than 2 crores. “DMC Act, 1957 was made when the jurisdiction of the MCD was only the city zone. A new Act is needed to replace the DMC Act, which is now outdated,” added the minister.Sources said that Delhi government has already sounded experts like R.D. Gupta, who drafted the Bed and Breakfast Bill, along with Sudheer Vohra for framing the new law.
