‘Driver’s duty to take care of people crossing roads’
A Motor Accident Claims Tribunal (MACT) court said that it is the duty of the drivers to take care of persons crossing roads while awarding `5.75 lakhs compensation to the family of a woman crushed to death by a crane near Ghazipur traffic intersection.
The victim, Manju Pandey, was hit by a crane in 2009 and succumbed to her injuries the same day.
MACT judge Arvind Kumar, said, “It is the duty of the driver, driving the heavy vehicles to take care of the persons crossing the road. It can be easily inferred that if the speed of the offending vehicle (crane) had been slow, the driver might have applied brakes in time and could have avoided the accident.”
The judge also discarded the testimony of an eyewitness, who testified that Manju was crossing the road carelessly, as “not trustworthy.”
Manju and her husband were going to Patparganj Industrial Area.
As they reached Ghazipur traffic intersection and were crossing the road, a crane coming from the Ghazipur village side allegedly hit Manju, injuring her seriously.
She was rushed to nearby Dr Hedgewar Arogya Sansthan where she succumbed to her injuries the same day.
