ASJ court specified as children’s court

The Delhi government has specified the court of additional sessions judge as children’s court for dispensing justice to the child victims of various offences and bringing to book the violators of child rights. The moves comes five years after the Commissions for Protection of Child Rights (CPCR) Act, 2005, was passed and required the state to specify a particular court that would be treated as children court.

The notification, dated August 4, provides for making the court of additional sessions judge (ASJ)-1 of each police district in the capital as dedicated child courts. There are 11 police districts in the capital and the courts concerned are located Patiala House, Tis Hazari, Karkardooma, Rohini and Dwarka.
As per Section 25 of the CPCR Act, the state, in consultation with the high court concerned, was supposed to specify a children courts in each police district.
These courts will deal with cases in which children are victim of offences. These will range from child sexual abuse, child rape, child labour to kidnapping of children, forcing them into prostitution and other offences. The cases in which the children are offenders will continue to be dealt with by the Juvenile Justice Board as per existing provisions.
“It is one step forward in direction of protecting the children against various forms of abuse and also help them get their rights,” said Raaj Mangal Prasad of Pratidhi. He added that these courts will ensure speedy trials in cases where children were victims. “With the special law being mulled for children, these courts may also come in handy in future,” said Mr Prasad.
At present, with the cases in which children are victims being dealt with in the general courts, the trial process tends to take a long time often leading to the accused getting acquitted due to lack of evidence.
