Court finds victim guilty, lets off biker
A motorcyclist, sentenced to a year in prison by a trial court for injuring a pedestrian by his rash driving, was let off by a sessions court after it found the victim to be in a hurry to catch an auto.
Additional sessions judge Surinder S. Rathi acquitted the convict after finding lacunae in the prosecution evidence, including absence of the accused person’s name in the First Information Report, which the police had registered without the details of the incident.
“Even as per as the accusation of driving the vehicle in a rash and negligent manner, the victim has stated in the court that he was standing on the carriage way at the spot, 4-5 feet from the footpath. He had signalled an auto to stop and was rushing towards it when he allegedly rammed into the motorcycle. “Once this fact has been conceded by the injured, I see no reason as to how it can be said that the motorcycle was being driven in a rash or negligent manner,” said ASJ Rathi, setting aside the magisterial court ruling, which had convicted and sentenced east Delhi resident Rajesh Anand.
