Court likens accused to ‘Kumbhkaran’ for laxity
A sessions court has compared an accused with the mythological character Kumbhkaran, the brother of demon king Ravana in the epic Ramayana for taking nearly three years to challenge a magisterial court’s order for his trial in a cheating case.
Additional sessions judge (ASJ) M.R. Sethi was irked with the accused, Suraj Bhan Jindal, who moved the court after three years, went on to miss three hearings on his appeal in the sessions court on three consecutive days earlier this month.
“Kumbhkaran used to sleep for six months in a year. The petitioner before this court is no less,” ASJ Sethi noted in his order, while dismissing the appeal of the accused.
Jindal had moved the sessions court on March 8 this year against the magisterial court’s April 1, 2008 order for his trial in a cheating case.
Charges were framed against Jindal and two others for offences related to cheating and criminal conspiracy in a case registered at the Moti Nagar police station here.
The court dismissed the petition of the accused saying, “The said ground cannot be held sufficient entitling the petitioner to condonation of delay. Reasons for delay have not been justified.”
“This court is of considered opinion that neither there is any ground to condone the delay in filing the revision petition nor the revision petition is liable to be accepted on merits,” it added.
