Court rejects CBI clean chit to Kanth
Former IPS officer Amod Kanth is in trouble as a Delhi court on Thursday rejected the closure report of the CBI, which has given a clean chit to him in the Uphaar inferno case, after noting that there was sufficient evidence to prosecute him for allegedly allowing extra seats in the hall which allegedly led to closure of exit gates where 59 cinegoers died in the blaze 13 years ago.
Issuing summons against Kanth for August 20, metropolitan magistrate (MM) Sanjeev Kumar, dismissed the CBI’s closure report and said, “There was sufficient material to prosecute Kanth under Section 304A (causing death by rash and negligent act), 337 (causing hurt by an act which endangers human life) and 338 (causing grievous hurt by an act which endangers human life) of the Indian Penal Code (IPC).”
Senior criminal lawyer, K.T.S. Tulsi, appearing for the Association of Victims of Uphaar Tragedy (AVUT), had alleged that Kanth, the former deputy commissioner of Delhi police (licensing), had allegedly allowed extra seats in Uphaar cinema hall’s balcony which allegedly led to closure of exit gates.
