Court shortens sentence of 75-yr-old
Age came to the rescue of a 75-year-old man, who was earlier sentenced to one-year imprisonment in a case of bounced cheque as a city court let him off with a much lesser punishment.
Passing the order recently, additional sessions judge (ASJ) Rajneesh Kumar Gupta, said that taking into consideration the age of the appellant, the earlier order was being modified and he would now have to pay a compensation of `2 lakhs to the aggrieved party.
The appellant, Laxmi Narayan, a resident of Ranhaula village in west Delhi, had challenged a lower court order directing him to give a compensation of `3 lakh and undergo one-year imprisonment.
Earlier, complainant Neelam Devi had told the court that she had extended a loan of `1.5 lakhs to Narayan nearly four years ago.
He had subsequently given a cheque of the full amount, which got dishonoured with the bank concerned saying that the accused had asked for stopping payment on his cheque.
Ms Neelam then filed a complaint against him under the Negotiable Instruments Act alleging that Narayan initially did not pay back the amount along with the interest, and later gave her a cheque that bounced.
Narayan had submitted before the court that the cheque was stolen from his house and Ms Neelam had misused it.
The court did not agree with his contention, however.
