Court summons top cop on withdrawal of notice
A Delhi court on Tuesday asked an additional DCP to appear before it and explain the withdrawal of a “look-out circular” (LOC) against two German directors of a multi-national company in a cheating case.
“I am constrained to summon M.A. Rizwi, additional DCP, who, as stated by the investigating officer, has played a collective and crucial role in making decision for withdrawal of LOC. He be summoned for June 8 at 10 am sharp,” additional chief metropolitan magistrate Rakesh Pandit said. He also asked that why the decision of withdrawal of LOC is taken by the investigating agencies having knowledge of the order dated March 21, 2011 and also not informing the court. “All these things do not appears to be done in normal course of business. In these circumstances considering the gravity of the case, it smells some what otherwise,” the court said.
The court passed the order after hearing an application filed by advocate Manish Jain on behalf of Tinna Finnex Ltd, claiming that the LOC was withdrawn in a clandestine and surreptitious manner against the two accused German directors who may not come back to face prosecution.
Earlier, an FIR was lodged against company ADM Interoceanic Ltd and its three directors — Kong, Martin Kropp and Peter Hopp. It was alleged that the accused company and its officials forged various documents to get illegal financial benefits.
As the two German directors did not join the investigation, LOC was issued against them, the application filed by Mr Jain said.
