Delhi secy, MCD get court notice
Taking notice of the car dealers who have encroached on the road and footpath below Defence Colony flyover in south Delhi, the Delhi high court on Saturday issued contempt notices to the chief secretary of the city government, the police and MCD chiefs for their failure to take action. In the notices the high court has asked actions against the car dealers.
The court has also asked for an explanation from the DDA vice-chairman, the DCP (traffic police) and some car dealers running shops in car accessory market, acting on a contempt petition filed by a group of shopkeepers accusing the authorities of not complying with the high court’s July 2008 order for removal of encroachments from the area.
Meanwhile, Justice G.S. Sistani in a recent order has also asked to “issue notice to show cause to the respondents as to why contempt proceedings should be not initiated against them”. The court sought a reply from Rakesh Mehta, chief secretary, NCT government, police commissioner B.K. Gupta and MCD commissioner K.S. Mehra by December 15. Filing the contempt petition through counsel R.K. Saini and Sitab Ali Chaudhary, the Flyover Complex Welfare Association of Defence Colony said that despite a court order in July 2008 to the concerned authorties, encroachments have not been removed, causing inconveneience to general public.
The petitioner said “by the active connivance of officials of the MCD, the DDA and the Delhi police, car dealers have been allowed to carry out their trade and business on footpaths. “There is also utter disregard to the orders passed by the division bench of this court,” the petitioner added.
Justice Sistani directed the concerened officials from the MCD and the DDA to remain present in the court on December 15.
