HC bench to Hear convicts’ appeal feb. 1
The Delhi high court will on February 1, 2012 hear the appeals of Vikas and Vishal Yadav, serving life term in the 2002 Nitish Katara murder case, challenging their conviction and sentencing by the trial court .
Vikas and Vishal were sentenced to life in May 2008 for killing Katara, a MBA graduate, on the intervening night of February 16-17, 2002 as they were against his relationship with their sister Bharti.
A bench of justices S. Ravindra Bhat and Pratibha Rani decided to hear final arguments on the appeals of the convicts on February 1 and 2, 2012. It asked the defence and prosecution counsels to file brief synopsis of the case in two weeks.
The bench said it will also hear the plea of the victim’s mother Neelam Katara, who has sought enhancement of life term to capital punishment for the convicts.
The court’s order came on an application filed by Vishal Yadav seeking early hearing of the appeals while citing the Supreme Court’s recent order asking the high court for expeditiously disposing of their appeals. The duo has also sought bail on the ground of delay in hearing of their appeals, saying that they have been behind bars for more than seven years.
