HC: Can NCT order DERC to hold tariff review order?
A division bench comprising Chief Justice of the Delhi high court Dipak Misra and Justice Manmohan on Wednesday sought the Attorney General’s view on the question whether the NCT government has the power to issue direction to the Delhi Electricity Regulatory Commission (DERC) to put on hold its decision on approved tariff for the year 2010-2011.
The division bench said, “Whether the state government has the power to interdict any statutory commission by issuing directions not to release its decision on tariff... Does it come under the ambit of NCT government? We want clarity from the Attorney General as the Electricity Act 2003 is a Central legislation.”
The court was hearing a PIL seeking a direction to the city government, which allegedly succumbed to the pressure of discoms on hike in tariff and asked DERC not to make public its approved tariff for the current year. The petitioner also sought to vacate the stay on the DERC’s approved tariff.
