HC raps cop for harassing woman
The Delhi high court rapped a Delhi police constable for misbehaving with a woman last year and turned down his plea to quash the FIR registered against him. The court slammed the constable for his shameless act and misuse of official position. The constable subsequently withdrew his petition.
Passing the order on Friday, Justice Ajit Bharihoke said that the appellant constable Bharat Rattan deserved to face trial for his act. The court also asked as to how he could misuse his official position. The court said that police uniform was given to him to protect the citizens in need, but instead, he was trying to enjoy the power and misuse it for assaulting a woman, which was shameless. The court told the appellant that either he withdraw his petition or it will be dismissed. The petitioner then decided to withdraw his petition. The court also took note of the fact that another policemen was also involved in the incident.
Last year, constable Bharat Rattan was arrested on March 25 with an associate on charges of outraging the modesty of a woman in Model Town, northwest Delhi. The woman was on her way to home when the accused, travelling in a car, approached her and misbehaved with her. Following the registration of the FIR, the constable was suspended. He was dismissed from service after a chargesheet was filed against him. However, in August 2010, he was re-instated.
The complainant woman, after coming to know that the constable was young and had a family to take care of, looked at his plight sympathetically and agreed to be part of the application for quashing of the criminal case registered against him. Constable Rattan and his friend then approached the court on March 14, but was denied relief.
