HC rejects plea against Delhi govt
The Delhi high court on Tuesday dismissed the contempt plea filed by an NGO against the Delhi government for taking no action against some private schools for their alleged failure to comply with its earlier order fixing 4 years as the entry age of a child for admission in pre-primary class.
After hearing the contempt petition filed by Social Jurist, Justice G.S. Sistani, said “No contempt petition is maintainable against the respondent (NCT government).”
The court, however, allowing the stand of the government, said that it will not consider as a part of formal education of a child in case he/she was given admission below the age of 4 year in the pre-primary class.
The government, in its affidavit, stated that the pre-school education should be for one year instead of two and the same stand was taken by it in 2007.
Ashok Aggarwal, appearing for the NGO Social Jurist, in the petition stated that the government has allegedly failed to comply with the court’s earlier directions to prohibit schools from taking children below 4 year for admission in pre-primary class.
Mr Aggarwal alleged that several schools in the city have been admitting children after attaining the age of 3 and some schools even take children who completed 2 years by violating the Delhi Education Act (DEA) which fixed completion of 4 year as the entry age for admission in pre-primary class.
The Delhi government, in its affidavit before the court, said its education department will establish a monitoring mechanism in each district.
