HC restrains DERC, govt from power tariff revision
The Delhi high court on Wednesday restrained the city government and the Delhi Electri-city Regulatory Commi-ssion (DERC) from implementing the revised tariff structure till January 20.
Pulling up the city government and the DERC for revising the tariff structure even though the matter is pending in the court, the division bench said, “We express our displeasure over this. Once we are seized of the matter, then how can the commission go ahead like this? Why do they play game of chess?”
The court also made it clear that neither the DERC nor the Delhi government will make changes in the electricity tariff till January 20, which is the next date of hearing in the case.
Additional solicitor-general (ASG) Parag Tripathi, however, submitted that new tariff structure would not be implemented without the court’s approval and recommendation of the committee would be placed in a sealed envelope before the court.
The court was hearing a PIL seeking a direction to the Delhi government which has allegedly succumbed to the pressure of discoms to hike the tariff.
According to the petitioner, Nand Kishor Garg, the commission has recommended a 40 per cent tariff hike based on the annual revenue returns filed by the discoms, according to which the companies have generated a surplus amount of approximately `3,577 crores.
