HC upholds sacking of doctor couple
The Delhi high court has upheld the decision of the Municipal Corporation of Delhi (MCD) to terminate two ad-hoc Ayurveda doctors from service, saying that the two did not have a legal right over their jobs and their conduct during the service created unworkable conditions for their colleagues.
The two doctors, Sunil Chaudhary and Neena Shad, are husband and wife. They were recruited on contract basis as medical officers with 39 others during 2001-002. The services of 39 recruits were regularised after completion of their probation. The civic agency, however, refused to regularise the services of the couple.
During her probation, Neena had filed three complaints of sexual harassment against her colleagues and sub-ordinate staff which on investigation were found to be unsustainable. The MCD had referred two complaints to the Sexual Harassment Complaints Committee for investigation but the woman and her husband refused to cooperate.
Dismissing their petitions, a division bench comprising Justices Pradeep Nandrajog and Justice Mool Chand Garg said, “In view of the conduct of the petitioners, the MCD is perfectly justified in dispensing with their services. No fault can be found in the decision of the local body.’’
The division bench held the woman’s husband guilty of creating nuisance at her work place, though he was posted at a different dispensary.
