HuJI convict’s plea for acquittal rejected
The Delhi high court has dismissed the plea of a member of banned terror outfit Harkat-ul Jihad-al-Islami (HuJI) challenging his conviction for plotting to kidnap cricketers Sachin Tendulkar and Sourav Ganguly.
A bench of Justices S. Ravindra Bhat and S.P. Garg dismissed the plea for acquittal in the case filed by Ghulam Qadir Bhat, who was earlier awarded the life sentence by a trial court along with five other HuJi members, including three Pakistanis.
The high court had earlier this week reduced the life sentences of all six, who were charged with offences under the Prevention of Terrorist Activities (POTA) Act, the IPC and the Arms Act, to eight years imprisonment .
In his petition before the high court, Qadir had challenged the judgment of the additional sessions judge, pronounced on December 24, 2010, holding him guilty along with the five other men of plotting to kidnap Sachin Tendulkar and Ganguly.
Qadir claimed that there was not sufficient evidence against him in the case and that the judge had held him guilty on the basis of false charges of the prosecution.
