MCOCA against other four accused likely
After invoking Maharashtra Control of Organised Crimes Act (MCOCA) charges against Ravi Kapoor, the prime accused in the Soumya Vishwanathan murder case, the prosecution is now arguing its case before a Delhi court to slap the same MCOCA against four other co-accused in the case.
Arguing its case before the Saket court special judge, R. Kiran Nath, the prosecution, said that the charges against other four accused — Amit Shukla, Baljeet Singh Mallik, Ajay Kumar and Ajay Sethi — are very serious in nature. As, the court has already slapped the MCOCA charges against Ravi, so we are pleading for the same to be invoked against the other four.
The investigating officer (IO) has already filed the supplementary chargesheet in the case against four accused under Sections 302 (Murder) and 34 (common intention to commit a crime) of the Indian Penal Code (IPC), it said.
The police, in its 489-page chargesheet, alleged that “Ravi Kapoor is a habitual criminal and besides becoming a terror in the mind of general public and running a criminal syndicate along with his associates, he not only killed innocent persons for pecuniary gains but also committed crimes of robbery and theft etc.”
Opposing the argument of the prosecution, Amit Kumar, the counsel for accused Ravi, Amit, Baljeet and Ajay, said, “The reason behind invoking MCOCA against the four accused persons in this case is simply to make the case complicated, as the four accused are falsely implicated and after the incident, the police is totally clueless as to who are the accused persons in the case. To invoke the charges of MCOCA in this particular case is totally baseless and illogical. There is no need to invoke this MCOCA charges. By slapping the charges against the four accused, the police is trying to cover-up its failure.” After hearing the arguments of the prosecution and the defence, the court has fixed December 6 for framing of charges under MCOCA against the four accused. Kapoor, along with Mallik, Amit Shukla and Ajay Kumar, had allegedly tailed the TV journalist of Headlines Today and allegedly shot at her on the intervening night of September 29-30, 2008, when she was returning home by her car.
