OBC quota: Notices to Centre, Delhi, MCI

The Delhi high court has issued notices to the Union Government of India, the government of NCT, the health department, MCI, Lady Hardinge Medical College (LHMC), Maulana Azad Medical College and two others after going through the petition of an aspiring MBBS student for not implementing 27 per cent reservation for the OBCs in a section of medical colleges in Delhi.

While issuing notices to all the respondents, Justice Rajiv Sahai Endlaw sought their responses on July 9.
Twent one-year-old Ashhar Musharib Firdausi, an aspiring MBBS student has secured 97th rank in the entrance examination conducted by DU, has moved the high court seeking its intervention to direct the concerned medical colleges city which have not implemented the 27 per cent reservation for the OBCs.
Naushad Ahmad Khan, lawyer appearing for Firdausi, exclusively talking to this newspaper, said he is seeking admission in the OBC category for MBBS course. He added that the seats reserved for the OBCs in the three medical colleges in the city are less than 27 percent as prescribed under Central Educational Institutions (Reservation in Admission) (CEI) Act, 2006. A copy of the petition, which is with this newspaper, says that a section of medical colleges in Delhi has not implemented the 27 per cent reservation for the OBCs.
Mr Naushad said, “This is a clear violation of the act under section 93 and article 15 (3) of the Constitution of India. A section of educational institutions in the national capital are acting monopolically not to mandate the CEI Act.” Mr Naushad added that the students should not suffer due to the alleged negligent act of the institute.
Opposing the argument of Mr Naushad, the counsel for the DU and faculty of medical sciences said as far as MAMC is concerned, it is run by the government of NCT of Delhi and the reservation policy with respect is decided by the government of NCT of Delhi only. The only university college of medical sciences fell under the university of Delhi.
