Shift all accused to city jail, says court
Rohini Court additional sessions judge (ASJ) Dr Kamini Lau has directed the Haryana government to move 100 inmates of Hisar jail to a prison here following the transfer of their trial in a case related to attack on dalits allegedly by upper caste Hindus at Mirchpur village in April last year.
The court asked the jail superintendent, Hisar, to ensure that the accused lodged there are transferred here if they are not facing criminal proceedings in other cases.
The direction was passed in view of the fact that the case relating to the killing of a 70-year-old dalit man and his physically-challenged daughter allegedly by a mob of 102 people was transferred to the special court here designated under the SC/ST (Prevention of Atrocities) Act, 1989 by an order of the apex court on December 9.
Meanwhile, the Haryana government also informed the court that it had requested the NCT government to appoint a special public prosecutor to follow the case, which is to come up for hearing on January 14.
The Supreme Court had earlier transferred the case to the special designated court in Delhi to ensure a free and fair trial. It had also said that the special court at Rohini will be free to re-examine witnesses already examined by the ASJ in Hisar.
The top court passed the order after examining the affidavits filed by two court-appointed advocates, who had submitted that the witnesses were under constant threat due to the hostile atmosphere created by the accused.
On April 21 last year, a dalit man and his daughter were burnt alive in violence against the community allegedly by members of an upper caste, forcing about 150 families to flee Mirchpur village in Hisar district of Haryana.
