Son deposes against mother, 3 brothers
In a first-of-its-kind case, a son has deposed against four of his family members, including mother, in a Delhi court. Appearing before the Karkardooma court of additional sessions judge Surender Kumar Singh, 40-year-old Surender testified that his mother and three brothers had allegedly trespassed his house and poured kerosene oil after brutally beating him and his children.
Surender, along with his children, lives in the ground floor of the flat in the Usmanpur area in East Delhi, where his mother, 65-year-old Kasturi Devi, and three brothers also stay on the first and second floor.
After the death of his father, Surender claimed he was given the ground floor to stay along with his children.
Amit Kumar, the lawyer appearing for the mother and three sons, however, argued that Surender allegedly tried to grab the entire property. No case of house trespass was made out against their client. Their fight of property dispute case was settled long ago when their father was alive.
Now the court has fixed for cross-examination of Surender by Mr Kumar for March 3, the next date of hearing in the case.
The court, after finding enough evidence, has initiated the trial against Kasturi Devi and three sons.
Following an FIR registered in the New Usmanpur police station in 2008, the court had framed charges against Kasturi Devi and her three sons under sections 34 (Common intention to commit a crime), 308 (Attempt to commit culpable homicide), 452 (House trespass after preparation for hurt, assault or wrongful restraint) and 506 (Criminal intimidation) of the Indian Penal Code.
