Woman told to pay former live-in partner
The Delhi high court has asked a woman to pay `30.7 lakh to her former live-in partner to compensate him for allegedly misappropriating his gold and silver jewellery and `70,000 in cash, kept in her care when they were living together.
The partners, Surendra Kumar Jain and Jyoti, were living together at a rented house at Gandhi Nagar in east Delhi. They also had two children during that period.
Some disputes, however, arose between the two after which Mr Jain stopped staying with Ms Jyoti.
When one day he visited the house, the neighbours told him that Ms Jyoti had married another man and left after locking the house.
Thereafter, Mr Jain sent several requests to her. Later, he served a legal notice to her seeking return of the gold and silver jewellery along with the cash that was in her possession, but there was no response from her.
Having failed to obtain what belonged to him, Mr Jain also filed a recovery suit against her.
To support his charge before the court, Mr Jain submitted the bills for purchasing the jewellery along with photographs of his former partner wearing the jewellery at different occasions.
Justice V.K. Jain decided the matter ex-parte as Ms Jyoti allegedly failed to appear before the court despite several summons and notices issued to her.
After going through the submissions made by Mr Jain, the court said, “I see no reason to disbelieve the un-rebutted deposition of the plaintiff. The bills show the purchase of jewellery,” and directed Ms Jyoti to pay `30.7 lakhs to Mr Jain to compensate him.
