Explain issue of summons, ACB court directs litigant
An ACB court on Monday sought clarification regarding the issue of summons to the accused in the case pertaining to denotification of 9.14 acres of prime land at Ameerpet. Former chief minister of the state K. Rosaiah is one of the accused in the case. The court sought clarification from the complainant by Wednesday while maintaining that there was no prayer in the original complaint to issue summons to the accused.
“The court was supposed to pronounce its orders today (Monday) but it sought certain clarifications. The prayer was there in the ‘protest petition’. It will pass orders after we file our clarification on Wednesday,” said T. Sriranga Rao, counsel for the petitioner. It may be noted that following a complaint by advocate Mohan Lal in December 2010 that Mr Rosaiah had caused a loss of Rs 200 crore to the state by denotifying the prime land in favour of private parties, the ACB court ordered registration of cases against him and 12 others.
After investigation, the ACB officials filed a report before the court that no evidence could be found agai-nst the then CM and, hence, requested the court to close the FIR on March 9, 2011. However, the court decided to examine witnesses following a ‘protest petition’ lodged by the petitioner. The court has already examined and recorded statements of IAS officers B.P. Acharya, the then HMDA commissioner; S. Appa Rao, the then principal secretary of municipal administration and C.V.S.K. Sharma, the then principal secretary to Mr Rosaiah.
