HC sends back inter Physics re-test order

A division bench comprising acting Chief Justice V. Eswaraiah and Justice Vilas Afzulpurkar of the Andhra Pradesh High Court has set aside the order of a single judge who directed the Board of Intermediate Education to conduct a re-test for Physics paper II for second year students who could not appear for the exam due to the delay in getting hall tickets.

The bench was dealing with an appeal by the Board challenging the single judge order. Additional advocate general K.G. Krishna Murthy argued that there was no provision under the Regulations of Examination to hold a re-examination. He said that the petitioners failed to remit the fee before the due data and he submitted certain papers to prove that the students paid the fee after the due date. He said that the single judge passed the order without giving an opportunity to the Board to submit facts. Setting aside the order on Thursday the bench found that there was various issues to be addressed and accordingly send the matter back to the single judge for fresh consideration.
The case will be heard by the single judge next Wednesday.

HC grants relief to coal workers
Justice P.V. Sanjay Kumar of the Andhra Pradesh High Court has directed the Singareni Collieries on Thursday to pay to its employees amounts due under the National Coal Wages without recovering amounts paid as one-time lumpsum advance in November 2011. The company had given Rs 25,000 as advance to employees who had participated in the Sakala Janula Samme in 2011 and declared that the recovery will be notified later. Without notifying the recovery, the management issued an order on June 9 stating that the amount will be deducted from the arrears of the local coal wage arrears paid to employees. Aggrieved by the order the Singareni Collieries Workers Union filed a plea contending that the recovery process had to be notified and such a process of lumpsum recovery was not envisaged.
