Officials say no conspiracy by Acharya, LV in Emaar

Sanction for prosecution of senior bureaucrats B.P. Acharya and L.V. Subrahmanyam, accused in the Emaar scam, has taken a curious turn with the top brass of the administration seeing no criminal conspiracy by the two as charged by the Central Bureau of Investigation.

The process of sanctioning the prosecution has reached a critical stage and Chief Minister N. Kiran Kumar Reddy is likely to make his recommendation to the Centre on this issue in a couple of days.

Sources told this newspaper that the state government, while sending its recommendation to the Centre, will register a strong protest against the CBI for openly accusing it of delaying the prosecution.

Chief secretary Pankaj Dwivedi is giving final touches to the note file to be sent to the Chief Minister.

A top official said that the accusation made by the CBI, in open court in its bid to prevent bail to Mr Acharya, was highly irresponsible.

“We followed the rule book in processing the file,” he said.

The verdict of special CBI court judge O.P. Saini discharging Union home minister P. Chidambaram of the allegation of criminal conspiracy in the 2G spectrum case is believed to be the basis of the recommendation made to the Chief Minister by the bureaucrats, sources added.

The officials were said to have taken a cue from observations made by the special court judge differentiating between criminal conspiracy and inadvertent and innocent acts.
