SC: No merit in charges against Naidu
The Supreme Court on Tuesday declined to interfere in AP High Court verdict quashing an FIR against Telugu Desam chief N. Chandrababu Naidu for allegedly “cheating” voters on the Telangana issue. A Bench comprising Justices S.S. Nijjar and Ranjana Prakash Desai dismissed the appeal filed by two advocates from AP, saying that there was no merit in the case.
An FIR was registered against Mr Naidu un-der Section 417 of the IPC (cheating) on the order of Metropolitan Magistrate, Cyberabad on January 9 on the complaint of advocates Sunkari Janardhan Goud and G. Krishan. However, the FIR was quashed by the HC on February 13. With the dismissal of their appeal, the top court upheld the findings of the HC’s single judge Bench deciding the matter on two important factors. The HC had said that the two lawyers failed to establish that they had voted for the TD and the basic ingredients of cheating as defined under Section 415 of IPC could not be established.
