‘No legal, moral consequences in live-in’
A London-based lawyer on Monday got a sigh of relief from the Delhi high court, which has said that a partner in a live-in relationship can walk out of it at any point of time without any legal consequence and neither of the partners can complain of infidelity if one ditches the other.
While quashing the criminal proceedings initiated by a woman against her live-in partner, a London-based lawyer, Alok Kumar, after he allegedly refused to marry her, Justice Shiv Narayan Dhingra said, “Live-in relationship is a walk-in and walk-out relationship. There are no strings attached in this relationship, nor does this relationship create any legal bond between the parties.”
Justice Dhingra also made it clear that people who chose to have live-in relationship cannot complain of infidelity or immorality as live-in relationships are also known to have been between a married man and an unmarried woman or vice versa. Mr Kumar moved the Delhi high court seeking quashing of the criminal proceedings initiated by a lady with whom he had live-in relationship.
Mr Kumar, in his petition, submitted to the court that he refused to marry the woman as his parents were against the relationship.
The court also pointed out the fact that the FIR should be quashed to prevent misuse of criminal justice system for personal vengeance of a partner of live-in relationship. Granting relief to Mr Kumar, the court said, “It is a contract of living together which is renewed everyday by the parties and can be terminated by either of the parties without consent of the other party and one party can walk out at will at any time.”
