2G: Kani files plea in HC, says ‘no proof’
DMK MP Kanimozhi on Friday approached the Delhi high court seeking “setting aside of the charges framed against her by a special CBI court trying the 2G spectrum allocation scam case”, the most grievous ones being that of criminal conspiracy and those under the Prevention of Corruption Act.
Ms Kanimozhi, facing trial in the multi-crore scam case, has claimed in her petition filed in the high court that there is no evidence on record against her in the case and that she has been wrongfully indicted by special CBI judge O.P. Saini. Her petition also seeks quashing of the “chargesheet filed by the CBI and all the proceedings emanating thereunder.”
The high court is likely to hear her plea on March 26.
The 44-year-old Rajya Sabha MP and daughter of DMK chief and former Tamil Nadu chief minister M. Karunanidhi was charged under various provisions of the Indian Penal Code and Prevention of Corruption Act on October 22, 2011 for allegedly playing a role in the 2007-08 telecom scam. Criminal breach of trust, criminal conspiracy, cheating and forgery of documents are some of the charges against her. She was named an accused in the case by the CBI in a supplementary chargesheet filed by it on April 25, 2011, following which she was arrested on May 20 and released on bail in November.
The petition filed by Ms Kanimozhi’s counsel Balaji Subramanian says, “It emerges from a mere reading of the chargesheets in the present case that there is absolutely no evidence of the petitioner being privy” in the conspiracy between officials of DoT and private persons in award of UASL licences by deviation from normal procedure.
“As per the prosecution, the alleged bribe money was paid to Kalaignar TV between December 2008 and August 2009. During that phase, her status was only that of a 20 per cent shareholder in the company. She did not participate in any board meetings where the decision regarding the alleged monetary transaction was taken, nor did she sign any documents pertaining to it,” reads the petition.
