Aarushi case: Nupur Talwar granted bail
The Supreme Court on Monday granted bail to Nupur Talwar, one of the co-accused in May 2008 Aarushi-Hemraj double murder case.
The apex court granted bail to Talwar as key witnesses have already been interrogated by the Central Bureau of Investigations (CBI).
A bench of Justice A.K. Patnaik and Justice J.S. Khehar ruled that Talwar be released in a week's time -- by September 25 -- and asked the CBI to examine missing witnesses by then.
Nupur, co-accused in the sensational 2008-murders along with her dentist husband Rajesh Talwar, has been lodged in Ghaziabad's Dasna jail since April 30.
The Central Bureau of Investigation (CBI), during the last hearing had argued that she could influence the witnesses, if granted bail.
The Court had accepted the CBI plea and the bench of Justice A.K. Patnaik and Justice J.S. Khehar told senior counsel Sidharth Luthra, appearing for the CBI, to complete the examination of 13 prosecution witnesses before September 17.
Appearing for Nupur Talwar, senior counsel K.V. Vishwanathan had told the court that the entire case was based on circumstantial evidence.
Vishwanathan had pleaded that Nupur Talwar be released on bail, and to address CBI's concerns, the apex court could impose any conditions.
He said that for the same offence, Nupur Talwar's husband Rajesh Talwar was out on bail.
A CBI trial court in Ghaziabad has charged the Talwars under sections 302/34 (murder with common intention) and 201 (destruction of evidence with common intention) of the Indian Penal Code (IPC).
In addition to these, the court charged Rajesh Talwar under section 203 (giving false information in respect of an offence committed) of the IPC.
