Assets case: Jayalalithaa gets summons

A special court here on Thursday asked Tamil Nadu chief minister J. Jayalalithaa and three others to be present before it on July 27 for recording their statements in a disproportionate assets case against them.

“The accused should be present,” judge B.M. Malli-karjunaiah said in his oral order fixing July 27 for recording of their statements under section 313 of CrPC (power to examine the accused).

Later, senior counsel for Jayalalithaa, B. Kumar filed a petition stating that he needed to make certain submissions on the legal aspects of section 313 post amendment in 2008.

After the amendment the section states the court may take the assistance of public prosecutor and the defence advocate to formulate questions under section 313. It also reads that the court may permit a written statement by the accused.

Mallikarjunaiah adjourned this petition for hearing to July 25 and posted the case to July 27 for recording of the statement of the accused — Jayalalithaa and her close friend Sasikala Natarajan.

Sudharakaran and Ilavarasi, relatives of Sasikala, are the other two accused.
