BJP leaders challenge CBI SLP
Senior BJP leader L.K. Advani and other senior BJP leaders, in a joint affidavit, challenged the CBI’s SLP in the Supreme Court, accusing the agency of attempting to revive an issue that has already been settled by the Supreme Court in its March 22, 2007 judgment.
They said the charge of criminal conspiracy under Section 120-B of IPC was neither in the two FIRs registered in the case nor in the CBI chargesheets filed before the special courts at Lucknow and Rai Bareili, where the cases were under trial.
In this regard, Mr Advani and the other leaders placed on record a judgment of the apex court of March 22, 2007, delivered by a three-judge bench comprising the then Chief Justice of India, K.G. Balakrishnan, and Justices G.P. Mathur and R.V. Raveendran, clarifying the legal position on the whole issue.
The SC had said that the first FIR, No-197/92 had included the charges under sections 395, 397, 332, 337, 238, 295, 297 and 153A of IPC. And second FIR, No-198/92 contained the charges under sections 152A, 153B, 505, 147 and 149 of IPC.
