Can state intervene in CBI cases: SC
As several states have raked up the issue of federalism in the context of the proposed NCTC, the Supreme Court on Monday issued notices to the Centre and all the states on an important question of law whether the states have a right to file appeals in the cases investigated by CBI, the premier central investigating agency.
The issue was brought before the court by the Chhattisgarh government in a murder case against Amit Jogi, a son of former Chhattisgarh chief minister Ajit Jogi, who was acquitted of the murder charge but the CBI not filing any appeal in the top court. The Chhattisgarh government had challenged in the high court’s verdict upholding the acquittal of Amit Jogi by the trial judge. After upholding the verdict of the trial court, the HC had not granted any “leave (permission)” to the state to challenged the verdict in the top Court. A bench of justices Altamas Kabir and S.S. Nijjar sought to know the stand of all the states on the important question of law.
