Court notice to DNA lab in Tiwari case
Joint registrar of the Delhi high court Deepak Garg on Monday issued a notice to Hyderabad-based laboratory seeking its response on the modalities to conduct DNA test on veteran Congress leader Narayan Dutt Tiwari to ascertain the plea of a 32-year-old Delhi-based lawyer Rohit Shekhar claiming to be his biological son.
Mr Garg has sought a response on April 20, from the Centre for DNA, Fingerprinting and Diagnostics (CDFD) in Hyderabad.
Recently, Justice Gita Mittal of the Delhi HC in her order had allowed the appeal of Mr Shekhar to conduct the DNA test on 85-year-old Tiwari.
The response of the laboratory was required as to how it would go for the test and how much time it will take in ascertaining the outcome, said Mr Garg, who would record evidence for enabling the court to decide the plea of Mr Shekhar that he be declared the son of the veteran Congress leader.
Earlier, Justice Mittal had modified an earlier order by asking CDFD, instead of Centre for Cellular and Molecular Biology (CCMB), to conduct the DNA test. Mr Shekhar had submitted the CCMB, which was initially asked to conduct the test, was no more conducting such tests.
The octogenarian leader, even did not get a breather from the Supreme Court, which had refused to stay the HC order asking him to undergo the DNA test in the paternity suit filed by Mr Shekhar.
Earlier, the HC had dismissed Mr Tiwari’s appeal against the single judge order asking him to undergo DNA test on a plea made by Mr Shekhar claiming to be his biological son.
