Court rejects plea against Ashok election
In yet another major reprieve to former Maharashtra CM Ashok Chavan, the Aurangabad bench of the Bombay high court has rejected a petition challenging his election in the 2009 state Assembly polls.
The court’s judgment comes a week after the Congress won the municipal elections in Nanded under Mr Chavan’s leadership.
Petitioner Madhav Kinhalkar had challenged Mr Chavan’s election in 2009, accusing him of tampering EVMs and “publishing paid news”.
In the judgment pronounced on Thursday, Justice R.M. Borade dismissed the election petition against Mr Chavan in 2009, on the grounds that “the petition does not disclose material facts”. Dr Kinhalkar had lost the 2009 Assembly election against Mr Chavan in the Nanded.
Justice Borade said, “It is not clear as to whether the respondent Mr Chavan or his election agent or any other person at the instance of Mr Chavan has incurred excess expenditure. It is neither pleaded as to whether the publications of alleged paid news were prior to presentation of nomination by Mr Chavan or thereafter. It is also not clear as to whether the alleged publications reflect personal views of the editor/journalist or the publications at the instance of Mr Chavan.”
