Hyderabad: The Cyberabad police, which busted an alleged illegal Brazilian Real transaction racket in Saroornagar, goofed up by booking a case under the Foreign Exchange Management Act though the police is not empowered to book cases under the Act.
Officials of the Special Operations Team, Cyberabad, arrested four men for trying to sell the currency to people here who had Brazilian accounts for a much lesser price. The team recovered about 1,62,450 reals which is equivalent to Rs 50 lakh.
Enforcement Directorate sources meanwhile said that the police can’t issue FIRs as only the ED can book cases under Fema. “In fact they have approached us and we have asked them to deposit the currency in court so that we can take it up. Local police have no power to investigate cases under Fema,” said an ED source.
Assistant Solicitor General of India in AP High Court P. Vishunvardhan Reddy said, “Police can’t book a case under Fema. It is the jurisdiction of ED. However Section 38 of Fema allows the central government to empower a police officer to investigate the case.
But the central government has to specifically issue an order. In this case as the Centre didn’t issue an order the case becomes void.”
“The ED has to register a fresh case and take the money from the court where it has been already deposited,” he added.
However SOT assistant commissioner of police K. Goverdhan Reddy said, “We can book a case under the Act and carry out investigations till the Enforcement Directorate takes it up. Since we have the accused, we registered the case.”
Acting on a tip-off, the SOT along with a local police team had laid a trap and apprehended the gang which was trying to sell the reals for Rs 10 though the actual value is Rs 25.
A case was registered under Section 420 (Cheating) of the IPC and section 39(a),(c) of the Fema Act.
