CWG probe: Darbari bail plea rejected
Patiala House court special CBI judge A.S. Yadav on Tuesday dismissed the anticipatory bail application of T.S. Darbari, the former joint director-general of the Commonwealth Games Organising Committee (OC), in an another corruption case relating to procurement of video screens from a London-based firm last year.
After hearing the arguments from both the prosecution and the defence, the court said, “The matter involves crores of rupees and in view of the serious allegations made against the accused, I do not find it appropriate to grant him anticipatory bail. His application is dismissed.”
Darbari, who was arrested by the CBI in one of the two cases registered against him along with two other OC officials — Sanjay Mahendroo and M Jayachandran — has moved the anticipatory bail application to thwart his possible re-arrest in another case.
While rejecting Darbari’s plea that he could be re-arrested with an aim to harass him further, the court said, “At the outset, I may say that if the accused is arrested in one of the case, it is no ground to grant him anticipatory bail in another case.”
Senior advocate R.N. Mittal, appe-aring for Darbari, argued that the accused had no role in it as the decision to procure video screens was taken by the Empowered Committee headed by Suresh Kalmadi.
The accused submitted that the agency had deliberately arrested him in connection with only one case with an aim to harass him later in the other matter.
The court said such issues could be taken care of by the probe agency during the investigation.
