Delhi HC refuses to stay Blueline phaseout
Another attempt by Blueline bus operators to buy time before the phaseout deadline of December 14 was rejected by the Delhi high court on Tuesday. The court refused to entertain their plea seeking stay against the phaseout notification of the Delhi government. A bench headed by Justice A.K. Sikri did not admit the plea of the operators
in which they had sought the stay on the ground that it would lead to loss of income and livelihood for them. This was the second time the bus operators had used the argument to seek a stay on the October 27 Delhi government notification which said that nearly 2,400 Blueline buses would be phased out.
In their earlier petition before a bench headed by Justice S.K. Kaul, the operators had pleaded for a stay on the grounds of livelihood. However, the court had rejected their demand saying the lives of people were more important than their livelihood.
Blueline buses acquired a negative image as they have been involved in fatal accidents due to rash driving and competition between buses on same route.
Government figures said that at least 182 people were killed in accidents involving Blueline buses in 2005. The number of people killed in 2006 was 163, while in 2008 at least 108 people lost their lives. In 2009, the Blueline buses were involved in fatal accidents leading to the death of at least 115 people.
After failing to get the Blueline buses phased out over the past four years primarily due to lack of adequate fleet of the DTC, the government is now confident that it would be able to make up for the lack of buses with large scale acquisitions by the DTC.
