District judge gets SC notice
An attempt by the Ghaziabad district judge to “interfere” in the trial proceedings in a special CBI court under his jurisdiction in the infamous provident fund scam against six former judges, including the three who had retired from Allahabad high court, has landed him in soup with the Supreme Court issuing notice to him asking to explain the reasons.
A special bench of the Suprme Court monitoring the investigation into one of the biggest scams of the Indian judiciary took serious note of Ghaziabad district judge (DJ) Vishnu Chandra Gupta’s alleged attempt to “intimidate” the CBI prosecutor.
The apex court bench of Justices D.K. Jain, V.S. Sirpurkar and G.S. Singhvi gave four weeks’ time to Mr Gupta to file response “explaining the reasons” for his interference as stated by the CBI in its affidavit levelled serious allegations against him.
The top court also issued notices to the three former HC judges, three ex-district judges and 64 other accused persons, facing trial in the case, on the CBI’s plea for transfer of the case outside Uttar Pradesh, preferably to national capital’s Tis Hazari Courts to ensure “free and fair trial”. All the accused were also given four weeks to respond to the CBI’s transfer petition while the agency furnished complete addresses of all the 70 accused as demanded by the top court in last hearing.
The former HC judges facing trial are; Ram Prasad Mishra, R.P. Yadav and R.K. Mishra Mishra and the three ex-district judges, include Ajay Kumar Singh, Radhey Shyam Chaubey and Arun Kumar.
