HC considers Balwa iPad plea
The Delhi high court on Wednesday asked the Tihar jail authorities to thoroughly examine an iPad to be used by the 2G spectrum scam co-conspirator, Asif Balwa, for reading digitalised case files in the prison, to ascertain if the electronic gadget can be misused for communication.
After going through Balwa’s plea, director of Kusegaon Fruits and Vegetables Pvt Ltd and an accused allegedly involved in the 2G spectrum scam case, Justice S. Muralidhar said, “An iPad be submitted at 11 am tomorrow to the Tihar jail officials who will get it checked by the IT department of the Delhi government as to whether it can be misused for communication or not.”
Balwa has moved the Delhi high court on Tuesday seeking the intervention of the court to allow him to carry an iPad having digital version of the CBI chargesheet and to use cooler inside the jail at his own expenses. Earlier the Delhi government on Wednesday submitted to the court that it was unable to provide an iPad to Balwa, on the ground that as per the jail manual, an accused lodged in the jail could not be given such a facility.
After hearing the submissions made by the Delhi government, the court said, “Times have changed. At any stage, you can withdraw the facility if you find that iPad is tampered with and is being used for sending e-mails or communication.”
To this, the government counsel said security personnel are not equipped to detect any tampering with the gadget.
The court, meanwhile, allowed home-cooked vegetarian food to Asif Balwa twice a week.
The court has now fixed the matter for further hearing till May 27.
