Hyderabad: What is the CBI inquiry against you about?
Senior IPS officer Umesh Kumar had been accused in a forgery case pending before the Chief Metropolitan Magistrate Court. He had filed 19 writ petitions in various courts to get relief in this particular case.
After failing in all his efforts, he finally approached the Supreme Court under Section 482 of CrPC with a sole prayer in the Special Leave Petition seeking quashing of proceedings against him in the CMM Court.
The Supreme Court rejected his prayer. And while doing so, it directed the CBI to inquire into the 542 sale deeds which Umesh Kumar had put in his forged petition of MP M.A. Khan.
Why was this forged petition, which came from the Union home ministry to the state government, not inquired into?
Because it was proved that it was forged. As per Central Vigilance Commission guidelines, forged petitions need not be inquired into by governments.
Why do you think he put 542 documents in the petition?
In 1996 I bought 10 acres of land near Mamidipally, on the outskirts of the city. If someone points this out, no one is going to believe that I am corrupt.
So Umesh Kumar thought if he showed 1,500 acres in my name, an inquiry would be ordered. He managed to get documents of X Y Z from the Mamidipally Registration Office and filed the forged petition.
When did Umesh Kumar do it? According to you what was his motive?
This happened in April 2011, just two months before I was to become DGP. He thought that if he would be able to get a petition forged, preferably by an MP, the state government would be asked to inquire into it and the government would refer this to the ACB which he was heading.
In the name of inquiry he could have delayed the issue so that the Chief Minister would be forced to not make me the DGP. If I was denied, naturally Umesh Kumar would have become DGP. That was his motive.
Do you think you will come out clean in the inquiry?
Definitely I will come out clean. Because the CBI, as part of its inquiry, will first of all have to ask Umesh Kumar to prove his allegations as per section 106 of the Indian Evidence Act.
As per law, the burden of proof lies on whoever files a petition. If he can’t prove the allegations he levelled against me, the Supreme Court will take a serious view of the matter.
