Ishrat Jahan case: CBI chief takes on Intelligence Bureau
New Delhi: Deciding to take the Intelligence Bureau (IB) head on in cases relating to fake encounters by the Gujarat police, CBI director Ranjit Sinha refused to buy the argument of the Union home ministry that the probing agency first needs to have sufficient evidence against intelligence officer before seeking prosecution sanction in the Ishrat Jahan encounter case.
Talking exclusively to this newspaper, Sinha said, “We do not require prosecution sanction against an IPS officer, if it is a case of fake encounter.
Probe by the CBI has already established that the case in point is of fake encounter which is not the part of the duty of any government officers. Therefore, the agency does not need prosecution sanction from the cadre controlling authority to prosecute an intelligence officers.”
He also said that in some case of alleged fake encounters which took place in Punjab during militancy and were probed by the CBI, no sanction of prosecution was needed.
The MHA has been maintaining that CBI does not have enough evidence to prosecute IB officers in the alleged fake encounter case.
“I would also like to clarify that let the competent court decide the sustanibility of the evidence,” Sinha said. The ongoing slugfest over the issue is really uncalled for, he added.
