Judge recuses in Kanimozhi case

The bail petition of DMK MP Kanimozhi will be heard on Monday by a bench headed by Justice G.S. Singhvi, who is monitoring the 2G scam case, after Justice P. Sathasivam, scheduled to sit as head of a vacation bench from June 20, recused from the hearing.

Highly-placed sources in the Supreme Court administration said Justice Sathasivam expressed his desire not to take up Kanimozhi’s bail case.

Though no specific explanation was given, the reason was that Justice Sathasivam belongs to Tamil Nadu and had served as a judge for a long time in the Madras HC. had also practised as a lawyer in the Madras high court earlier.

Since Justice Sathasivam is scheduled to sit with Justice A.K. Patnaik in the vacation bench from June 20, the former’s recusal would have disturbed the vacation bench’s composition.

Therefore a new bench was created to hear Ms Kanimozhi’s bail plea, sources said.
