Kani & 3 others move HC for bail
DMK MP Kanimozhi and three others accused in the 2G spectrum allocation case moved the Delhi high court seeking bail on Saturday, two days after their bail pleas were dismissed by a special CBI court. The three others are DMK-run Kalaignar TV MD Sharad Kumar and Kusegaon Fruits and Vegetables Pvt. Ltd directors Asif Balwa and Rajiv Agarwal.
Senior advocate V.G. Pragasam and S.J. Aristotle, appearing for Ms Kanimozhi and Mr Kumar, told this newspaper the trial court had denied bail to the DMK MP on the ground that she was a woman by saying she belongs to the upper echelons of society despite the Supreme Court giving her liberty to invoke CrPC Sec. 437 (when bail may be taken up in case of non-bailable offence) on the same ground. Neither CrPC Sec. 437 nor the Constitution discriminate between classes of women, especially on the basis of status in society, they said.
According to DMK sources, the party feels securing bail for Ms Kanimozhi will be sorted out favourably only in the Supreme Court, but the legal team representing her felt no purpose would be served by moving the apex court directly as it may direct them to first approach the high court.
