Land owner to get Rs 75L compensation
Chennai: The Madras high court has directed the slum clearance board to pay a compensation of Rs 75 lakh to an owner of a prime property for acquiring the land for constructing tenement blocks in 1977.
Of the 49 grounds owned by the trust Sri Srinivasamurthy Mandiram in T. Nagar, the slum clearance board had acquired 18 grounds under the Tamil Nadu Slum Areas (Improvement and Clearance) Act 1971. As the compensation was not paid, the land-owner has been waging a battle from 1977.
Disposing of the writ appeal, the bench, comprising justices Elipe Dharma Rao and N. Kirubakaran, pointed out that the notification under the slum clearance Act was issued only in respect of 18 grounds and taking over possession of the remaining 31 grounds was not covered by the notification.
However, the bench said, “Each ground would easily fetch about Rs 3 crore and the present-day market value of 31 grounds would be about `100 crore in T. Nagar, whereas the appellant (land-owner) very fairly and reasonably sought for only a paltry amount of Rs 75 lakh which is not even the cost of one ground. Therefore, it is fair to direct the authorities to pay the amount.
