‘Luke came to room 2nd time’
IPL team Royal Challengers Bangalore’s Australian player, Luke Pomersbach, has been accused of outraging the modesty of the woman on the intervening night of May 17-18 after a post-match party. During the arguments, the police submitted the medical reports of Sahil, the victim’s fiancé who allegedly suffered injuries in the brawl with the cricketer and is undergoing treatment at a private hospital here.
The police said Pomersbach first entered the room along with the woman, her fiancé Sahil and one Miraj to have drinks with them. He was, however, asked to leave when he misbehaved with the woman. The police said that Pomersbach, with a beer bottle in hand and accompanied by a friend, returned and tried to forcibly enter the couple’s room but he was “pushed back from inside the room” by them.
The public prosecutor said Pomersbach was “pre-determined” to commit the offence as he returned to the woman’s room a second time, and that the offence of IPC Sec. 452 of (house-trespass after preparation for hurt, assault or wrongful restraint) is made out against him as he had forcibly entered the room with intention to cause hurt.
Senior advocate Ramesh Gupta, appearing for Pomersbach, said they were not denying the presence of Pomersbach there but his entry into the room was friendly.
